The problem with DNA testing is that it's so powerful. It can provide insight to susceptibility to particular diseases, legitimacy of birth, and perhaps predispositions to certain behaviors and sexual orientation. People are constantly worried about discrimination. If one person's DNA shows he has a susceptibility to heart disease he could possibly be discriminated by insurance companies, government, employers, school, banks, and others. Most samples that are collected are not required to be destroyed. Whether the charged is innocent or guilty their whole genome is available. Although today the samples are considered "junk DNA", there is no telling how useful they will be in the future.
WHO SHOULD BE TESTED?
The United Kingdom has laws that allows a DNA sample to be taken from all suspects. The crime they are being charged with and the possibility they are innocent does not matter, a DNA sample can still be taken. In the United States arresting people without probable cause just to take a DNA sample raises questions about the fourth amendment.
A huge amount of DNA samples are waiting to be analyzed and entered into the CODIS system. Although the evidence would have been useful for conviction, in most cases the statute of limitations runs out.

Whose benefits from DNA testing?
DNA testing can be good and evil. In the older days poor DNA technology was the reason criminals weren't convicted. In these days DNA testing is much more powerful and beneficial. In the United States about 195 wrongfully convicted criminals have been freed from prison. In their eyes DNA testing is what saved them. DNA testing also affects fatherless children. There are many single mothers who aren't being paid child support, because the men who fathered their children are denying them. Paternity testing helps these mothers prove to the men that they really are the fathers.
